    MAXIMUM OCCUPANCY

    Maximum occupancy must not exceed the stated capacity. Guests must present at least one valid passport.


    NUMBER OF GUESTS - SUBLETTING

    Only those persons stipulated on the tenancy agreement may overnight in the property. Subletting and/or reassignment are strictly prohibited. The number of guests must not exceed the maximum number indicated in the tenancy agreement. Should the owner find that more than the specified number of guests is occupying the property he will be entitled to ask the clients to vacate the property immediately.


    ARRIVALS AND DEPARTURE TIME

    Check-in time is 16.00. Checkout time is 10:00. We cannot guarantee early check-ins or late checkouts unless confirmed by us in advance.


    PROPERTY DAMAGE

    The guests who signs the tenancy agreement is responsible for the correct and decent behavior of his party. Guests are responsible for any loss or damage caused to the property or its contents and is required to report any damage to the agent and to bear the cost of repair or replacement.     The tenant/ guests agrees to allow the agent or his authorized representative or any representative of the property owner, access the property at any reasonable and mutually convenient time during his stay to check the property for the sole purpose of essential repairs and/or maintenance in order to ensure that the tenant's/customer's comfort will remain at optimum level.     INSURANCES

    It is highly advised that your party is covered by travel insurance including coverage against trip cancellation, etc and against personal injury. The appropriate coverage should be purchased at the time of the booking. Please contact your travel agent, travel consultant or insurance broker from your country of residence about this.  The tenant/guests are responsible for his third-party liability, health and medical repatriation insurances. The property owner and agent will neither offer such insurances nor shall be held liable for the absence of such insurances. All tenants/ travelers are advised to have a medical plan that will cover any medical & travel expenses in Greece. In case of sickness or injury, the agent will do his best to have the patient reach professional medical assistance, the soonest possible. If a member of the party has any serious chronic condition, including severe allergies, the tenant/guests is obliged to inform the agent in advance.  In any case all tenants/guests are advised to bring ample supplies of the medications they normally need or take, because it may be difficult to find on location.


    GENERAL COMPLAINTS

    If there are any problems with the property or if the guests have any cause for complaint during the rental period, he must inform the agent immediately. The guests are obliged to give to the agent the necessary time to resolve the problem. If the problem is not resolved, the guests must follow up the complaint in writing to the agent within 24 hours.     TELEPHONE AND INTERNET

    Please note that our properties do not have telephone services, unless specified otherwise. In this case, we strongly recommend to travel with at least one mobile phone. When Internet service is provided at the property, we cannot guarantee we will be able to re-establish the connection in case of a technical problem beyond our control, such as a faulty line from the local telephone company. Please note that Mykonos’ internet infrastructure is still in the process of being improved and there may be disruptions to internet service.     GARBAGE

    Any garbage must be stowed in the proper garbage or recycling receptacle, located nearby the property.


    ELECTRICITY / WATER SHORTAGES

    The agent kindly asks you as tenant to use water sparingly, especially during the summer months. Electricity and water shortages may take place by the State Organization in some areas and while the property agent will do everything in his power to re-establish supply or remedy the situation, he cannot be held responsible for the inconvenience that such shortages may create.


    TAP WATER

    The tap water is not drinkable in Mykonos; please use bottled water. The guests should inform their party and visitors not to drink the tap water at all times.


    SEPTIC SYSTEM

    The septic is very effective; however, it will clog up if improper material is flushed.  DO NOT FLUSH anything in the toilet, including toilet paper. No feminine products should be flushed at anytime.  


    CHILDREN

    Children are welcome. Please notify us at the time of booking if there will be any children in your party and their ages. However, they are not allowed in the Swimming pools or in external spaces, unless properly attended by adults.

    SMOKING

    Smoking is not allowed in any inside area of the property as this is a nonsmoking property.


    PHOTOGRAPHY

    Photographs taken at the property cannot be used or sold for profit without the written authorization of the owner.



    REDUCTIONS

    No reductions or credit notes will be given under circumstances amounting to 'Force Majeure'. ln the above, 'Force Majeure' means war, threat of war, riot, civil strike, industrial dispute, terrorist activity, natural or nuclear disaster, fire, airline failure, epidemic, pandemic and adverse weather conditions or temporary pest problems at and around the Villa or any other event, situation, incident and natural causes outside our control.


    VALUABLES

    Valuables left at the property are at the risk of the guests. The owner and the property staff cannot be held responsible for their loss or misplacement. No responsibility is accepted for any loss of personal items while staying in the property or after departure.


    EVENTS – PARTIES

    The tenant/ guests agree to occupy and/or use the property in such a manner so as not to disturb the peace of the neighbors especially during off hours (14:30-18:00 and 23:00-8:00) or breach any and all applicable local legislation. For events and parties and in general in occasions that may disturb the peace of the neighbors, the tenant / guests shall need to have the agent’s prior consent who in his term in this respect shall have to notify the neighbors. Entertainment parties and functions involving invitees more than +10% above the max capacity of the property are strictly prohibited unless fully approved by the agent in advance and notified to him (where a special agreement with extra event fee may apply due to the extensive use and involvement of the cleaning and housekeeping personnel). In any case the extra invitees are not allowed to overnight at the property. Should the tenant/guests make an unauthorized use of the property, the agent has the right to ask all guests to evacuate the property immediately without further notice. In this case the security deposit will be fully forfeited until all applicable claims are fully settled with the property owner & agent and/or their authorized representative. In case the guests disturb neighbors with Music and the police gets involved after the neighbors’ complaints, neither the agent or the property owner will be held responsible for any kind of penalty addressed to the guests.


    SECURITY DEPOSIT

    The amount paid is in order to cover the cost of any damage to the property or its contents during the term of rental or for any unpaid services after check out. Any damages must be reported to the agent upon check out and pictures of the damages should be available. In case no damages or any unpaid services apply, the security deposit should be returned in full within 14 days after guests check out. In case the damages or unpaid services exceed the security deposit received, than the guests are obliged to pay the extra costs within 1 week from their departure. In cases of serious and/or structural damages that will be inflicted to the property by the tenant/customer or his service personnel (works of art-furniture-walls-flooring-carpets-pool-jacuzzi-machinery-electrics-A/C-TVs-domestic appliances) which will prevent the property of being rented to further tenants/guests, the property owner & agent will have the right to charge the tenant/guests besides the cost of the actual repairs, also with the full rental fee until the aforementioned damages will be restored in such a way that it will enable the property to be rented to and accepted by further tenants/guests.


    HOUSEKEEPING PROVIDED BY THE HOUSE OWNER/ MANAGEMENT COMPANY

    The villa will be cleaned before the guest’s check and thereafter it gets refreshed daily during the guests stay, this daily service usually lasts around 1-1,5 hour. Please note that the 1 set of towels of each Villa bedroom (that was used) gets changed every second day & the beds linens every third day. In case you request for more frequent change of towels and linen, please check with us and upon availability we might confirm; however extra charges will apply. In case the guests leave the villa every day very dirty and excessive cleaning beyond the included hours is needed, the agent has the right to deduct an excess cleaning fee in order to pay their housekeepers for their overtime; the cleaners in this case might split their shift and case and return as well in the afternoon based on their schedule of the day.

       

    CONTRACT / PAYMENT


    By paying the booking amount or part of it, the contract becomes effective, and both the broker and the tenant/guests automatically agree to all the above terms and conditions. Whatever is written in the present contract is all that has been agreed between the contractual parties and supersedes any other contract of previous date and both contractual parties agree that there is neither other valid oral nor written agreement in any form for the specific rental booking.


    SURVEILLANCE OF OUR VILAS

    The Tenant/guest acknowledges and agrees that our Villas can optionally equipped with security cameras, which are installed to monitor (with 24/7 in the camera system) the exterior of the villa, but exclude the monitoring and recording of any public areas that do not fall within the property's ownership (UNLESS there is an area that is owned by the property and there is no way to mount the camera at an angle that precludes viewing a public street/area that falls within the view of the private exterior of the mansion from a distance, this is considered acceptable recording, as all cameras are positioned to focus on PROTECTION of the property and are intended to enhance security measures on the property). There is no intention on the part of the villa other than to enhance security measures on the property and to avoid recording any activity in the public areas. Examples of areas with video recording may include: the parking area, all possible entrances to the Villa, the outdoor pool area and other outdoor areas of the Villa that are not considered indoor but belong to the property. These cameras are operated 24/7 to ensure the safety and security of the tenant/guest(s) and the property.


    ALTERNATIVE STAY OR FULL REFUND IN CASE OF TRANSFER OF THE PROPERTY OWNERSHIP

    In the event that the said villa in which you have booked under this agreement is sold or transferred to a new owner, and the new owner does not wish to honor your booking, the following provisions shall apply: 1. Alternative Accommodation: We and the villa owner will make all reasonable efforts to ensure alternative accommodation of equivalent specifications and size to those originally booked. This alternative accommodation will be offered to you for the same duration as your original reservation, provided there is relevant availability on the market. 2. Full Return: If the alternative accommodation as described in this term cannot be organized, or if you decline the offered alternative accommodation, we will provide you with a full refund of all payments you have made to us for the relevant reservation until the date of the above-mentioned reservation. 3. Update: In the event that the villa is sold or the property is transferred that may affect this reservation, we will provide you with immediate notice from the time we have been informed. 4. No Extra Obligations: After providing alternative accommodation or return as set forth here, we will have no additional liability or liability to you under this agreement, and you will not have any rights to damages, expenses or any other compensation arising from the transfer or sale of the villa.




    INDEMNIFICATION

    GOVERNING LAW/JURISDICTION

    This Agreement and its subject matter shall be governed and interpreted in accordance with the laws of Athens, Greece. Any dispute between the Parties whether resulting from a claim in contract, tort or otherwise, or any other claim or controversy which may arise out of or in connection with this Agreement or the application, implementation, validity, breach or termination of this Agreement, any provision thereof or any agreement concluded in pursuance to this Agreement shall be finally and exclusively settled by the courts of Athens, Greece.

    By accepting this agreement the tenant/ guests and all members of his party confirm that they have legally entered Greece for vacation reasons only and have the legal documents to prove it upon any such kind of request by the authorities. In the opposite case, the tenancy agreement is immediately considered as canceled and payment is forfeited in full.


    ALTERNATIVE ACCOMMODATION OR FULL REFUND IN CASE OF OWNERSHIP TRANSFER

    In the event that the villa reserved under this agreement is sold or its ownership is transferred, and the new owner does not wish to honor your reservation, the following provisions shall apply:

    1.    Alternative Accommodation: We and the villa owner shall make all reasonable efforts to secure alternative accommodation of comparable standards and size to the originally reserved villa. This alternative accommodation will be offered to you for the same duration as your original reservation, subject to availability.

    2.    Full Refund: If alternative accommodation as described in Clause 1 cannot be arranged or if you decline the alternative accommodation offered, we shall provide you with a full refund of all payments made by you up to the date for the aforementioned reservation.

    3.    Notification: In the event of a villa sale or ownership transfer that may affect this reservation, we will provide you with prompt notice of the situation from the moment we have been informed too.

    4.    No Further Liability: Upon providing alternative accommodation or a refund as stipulated in this clause, we shall have no further liability or obligation to you under this agreement, and you shall have no claim for damages, expenses, or any other compensation arising from the ownership transfer or sale of the villa.
